Are Court Records Public in McCurtain County?
Oklahoma’s Open Records Act, codified at Title 51, Sections 24A.1 through 24A.30 of the Oklahoma Statutes, establishes the right of any person to inspect and copy public records, including the records of Oklahoma’s courts. The Act’s underlying policy is to ensure that the public has broad access to government documents and that any exceptions to access are narrowly construed.
Despite this general openness, the law expressly protects certain categories of records from disclosure. At the McCurtain County District Court, the following record types are excluded from public inspection:
- Juvenile records — deprived and delinquent child proceedings are confidential
- Adoption records — sealed under Oklahoma law
- Mental health records — commitment and treatment proceedings are protected
- Records specifically exempted by other state or federal statutes
- Records covered by court orders sealing or restricting access
All other court records maintained by the District Court Clerk — including civil, criminal, probate, domestic, and small claims files — are available for public inspection. The clerk’s records date back to the early 1900s, giving researchers access to a lengthy historical archive. Where a record contains both exempt and non-exempt material, courts are expected to provide the non-exempt portions after redacting protected content.

Criminal proceedings in McCurtain County are handled exclusively by the McCurtain County District Court, which is part of Oklahoma’s 17th Judicial District, encompassing Choctaw, McCurtain, and Pushmataha Counties. The District Attorney’s office for the 17th District is located at the McCurtain County Courthouse, Suite 1, 108 N. Central, Idabel, Oklahoma 74745, Phone: (580) 286-7611
The District Court handles both felony and misdemeanor criminal matters:

- Misdemeanor and traffic cases — handled at the district court level as well; traffic and misdemeanor dockets are held twice monthly
Searching Criminal Records
Criminal case records — excluding juvenile delinquency matters, which are confidential — can be searched through the OSCN McCurtain County Docket Search or through ODCR for cases from 1998 forward. Searches can be conducted by party name or case number.
Arrest records that resulted in prosecution may appear in the district court’s case files. Arrests that did not lead to charges or court proceedings are not court records and would need to be requested separately from law enforcement agencies such as the McCurtain County Sheriff’s Office. Criminal history background checks for employment or licensing purposes are handled through the Oklahoma State Bureau of Investigation (OSBI), not the court clerk.
For in-person requests for criminal court records, contact the District Court Clerk at the address and phone numbers listed above.
