Recording fees for the first page of deeds, mortgages, and other instruments are $8.00, plus a $10.00 preservation fee per instrument and $2.00 for each additional page. Nonconforming documents carry a $25.00 first-page fee. The County Clerk accepts all major credit cards.

Creek County Family Court Records

Family law matters — divorce, legal separation, child custody, child support, paternity, adoption, and guardianship — are adjudicated in the Creek County District Court. The Court Clerk files and maintains all family case records.

Mandatory surcharges (ADR, law library, OCIS, CASA, records preservation, and others) are added to each base filing fee. Divorce records are public under state law; interested parties may search for them on OSCN or ODCR, or contact the Court Clerk with the names of the parties and the case number.

Marriage Records

The Creek County Court Clerk issues marriage licenses and records all marriages performed in the county. The standard application fee is $50.00 (28 O.S. § 31). If both applicants present a certificate of completion of a qualifying premarital counseling program, the fee is reduced to $5.00. A marriage ceremony performed by a judge costs an additional $10.00. Copies of recorded marriage certificates can be obtained from the Court Clerk; the first page costs $1.00 and certification is $0.50.

Birth and Death Records

Birth and death certificates are administered by the Oklahoma State Department of Health, Division of Vital Records. Birth certificates are sealed from public inspection and available only to qualified applicants (the registrant, a parent, legal guardian, or other party with a court order). Death records are restricted to parties with a direct relationship to the deceased; only death records 50 years or older are publicly available.

Confidentiality in Probate

Most probate records in Creek County are open to public inspection. However, certain proceedings carry access restrictions.
