Are Court Records Public in Cherokee County?

  • Ages 16–17: Parental consent required; 72-hour waiting period applies
  • Under 16: Marriage is prohibited except by court order
  • Post-divorce: Persons divorced in Oklahoma may not remarry anyone other than their previous spouse for 6 months after the divorce decree is filed

Certified copies of marriage records are available from the Court Clerk’s Office for $9.00 per copy, payable by cash, check, money order, or credit card, with valid photo identification required.

Birth and Death Records

Vital records for Cherokee County are maintained by the Oklahoma State Department of Health, Vital Records Service. Birth certificates in Oklahoma are not accessible to the general public until 125 years after the date of birth. Within that restriction period, access is limited to:
